ViYomi Terms of Service

In short
- ViYomi is an app for families. The parent presses one button each day, "I'm OK", and if the press does not arrive, the family is alerted.
- ViYomi is not a panic button and does not replace emergency services. In an emergency in Israel, call 101; elsewhere, call the local emergency number.
- There is a free version with no time limit. The paid version costs ₪19 a month per family, VAT included, and renews every month until it is canceled.
- On the website you pay through Paddle, which is the Merchant of Record for the order.
- You can cancel at any time, with no cancellation fee. If you ask for a refund, you get back what you paid for the days not used, and the paid version ends at once. The details are in the refund and cancellation policy.

2. What these terms cover
- These terms apply to anyone who pays on the website, on the payment page https://viyomi.web.app/en/pay/, for the paid version for a family that uses ViYomi. Usually that is one of the family's contacts, such as one of the children.
- They also describe the service being paid for, and what it does not do. They are the supplier terms that Paddle's Buyer Terms refer to.
- A "family" is one parent whose phone has the app, with that parent's contacts, up to five.
- A subscription bought inside the app, through Google Play, follows Google Play's terms for payment, cancellation and refunds.
- ViYomi is in a pilot, and features and wording may change. While everything ViYomi does is open to every family for free, there is nothing to pay, and the payment page says so.
3. What the service does
- Once a day, the parent presses "I'm OK" in the app on their phone.
- If no press arrives by the deadline, the parent gets a reminder on the phone.
- If there is still no press after the grace period, the contacts are alerted by SMS, a voice call or WhatsApp, as chosen for each of them. When the parent presses afterwards, they get a message that all is well.
- Whether there was a press is decided on ViYomi's server, not on the phone. So the alert goes out even when the parent's phone is off.
- When the parent's phone has not been in touch with the server for more than 26 hours, the main contact is told.
- On a paused day, and on Shabbat and holidays when Shabbat mode is on, there is no check, and no reminders or alerts go out.
- After three days in a row with an alert and no press, alerts stop until the next press, and the contacts are told. The parent still gets reminders.
- Messages and calls to the contacts are in Hebrew.
4. The free and the paid version

- The free version is always available, with no time limit. Nobody has to pay to keep using ViYomi.
- The parent's reminders are never limited, in either version.
- In the free version, the second alert of the month says it is the last one. From the third missed day to the end of the month, no alerts go out.
- In the paid version, calls go to the contacts who chose them, one after another in list order, until someone answers.
- WhatsApp is used when the channel is available, and only for a contact who approved it through a link sent by SMS. A message that does not arrive on WhatsApp goes out by SMS.
- When the paid version ends, the family goes back to the free version. The extra contacts are kept, but get no alerts until the family pays again, and each of them gets one SMS saying so.
5. Price and payment
- The price is ₪19 a month per family. This is the final price: it includes VAT and any other tax, where they apply, and nothing is added.
- The price is in shekels. You pay in Paddle's payment window, which opens from the payment page, by credit card, debit card, PayPal or another method offered there. Paddle's payment window is not available in Hebrew. With a card in another currency, the card company may charge a conversion fee.
- The first charge is on the day you pay. After that, the subscription renews by itself every month, with a charge of ₪19, until it is canceled.
- The paid version opens for the family as soon as the payment is confirmed.
- Paddle emails a receipt for every charge to the address typed in its payment window. On a card statement the charge shows as
PADDLE.NET* VIYOMI, and with PayPal asPAYPAL *PADDLE.NET. - If a monthly charge fails, Paddle may try again. If it still fails, the subscription ends and the family goes back to the free version.
- This offer is valid for as long as it appears on the payment page.
- If the price changes, an email will be sent at least 30 days before the first charge at the new price. You can cancel before then at no cost.
6. Paddle, the Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
- The purchase itself is made with Paddle, under Paddle's Buyer Terms. For buyers in Israel, and everywhere except the United States and Canada, the seller is Paddle.com Market Limited, registered in England and Wales under number 8172165, 30 Old Bailey, London EC4M 7AU, United Kingdom.
- Payment details are typed in Paddle's payment window and never reach us.
- We provide the service itself, under these terms. For questions about the service, and to cancel, you can always contact us too.
7. One family, one way to pay
- One payment opens the paid version for one family: the family of the parent whose name is shown on the payment page. A number that is a contact of several parents pays for each of them separately.
- A family pays in one way only: on the website, or in the app through Google Play. When the family already has the paid version, in any way, the payment page does not let anyone pay again.
- If the family buys a Google Play subscription while it has one on the website, the website subscription will not renew again. What was paid on the website stays valid until the end of the paid month.
- If the same days were still paid for twice, on the website and in Google Play, the website payment for those days is refunded, as the refund and cancellation policy says.
- A Google Play subscription is managed and canceled in Google Play, on the parent's phone. It cannot be canceled from the website.
- The family's settings, such as its contacts and how each of them gets alerts, are set in the app on the parent's phone. The payment page shows only the parent's name and the state of the paid version.
8. Cancellation and refunds
- You can cancel at any time, with no cancellation fee. After canceling there are no further charges, and the paid version stays on until the end of the paid month.
- If you ask for a refund, at any time, you get back what you paid for the days not used, and the paid version ends when the refund is made. Within 14 days of the first payment you can do this with no reason needed.
- All the ways to cancel, and when you get a refund, are in the refund and cancellation policy.
- Deleting all data in the app cancels the website subscription at once, and there are no further charges. The same happens when a family is deleted automatically, after a year in which the parent's phone was not in touch with the server. What was already paid for the month is refunded for the days that were left, if you ask.
- A Google Play subscription is not canceled by the deletion. It is canceled in Google Play.
- When the payer's number is no longer a contact of the family, the family no longer appears on the payment page for that number. Then cancel through Paddle or by contacting us.
9. What to know about alerts
- ViYomi is not a panic button, and does not replace a monitoring center or emergency services. No center watches the alerts, and nobody is sent to the home. In an emergency, call 101 in Israel, or the local emergency number elsewhere.
- The alert is sent from our server. For it to arrive, phone and internet networks have to work, and so do the providers that carry the messages and calls: the SMS providers, Twilio for calls, Meta's WhatsApp, and Google, where the server runs. So we cannot promise that every alert arrives, or that it arrives on time.
- The parent's reminder arrives on the parent's phone. It depends on the phone being on and online, and on the phone's system not having stopped the app.
- A press only says that someone pressed the button. It is not a health check, and ViYomi gives no medical advice.
- An alert only says that no press arrived. All may be well, for example if the parent forgot to press or the phone was left at home.
- Every message and call is logged. A failed send is tried again, and faults are fixed as quickly as possible.
10. What we ask of the family
- Add only contacts who agreed to receive alerts. The app suggests what to say when asking.
- Keep phone numbers correct, and update them in the app when a number changes.
- Keep the app installed on the parent's phone, with notifications on.
- Use the payment page only for a family that the number entered there is a contact of.
11. Our responsibility
- We make reasonable efforts for the service to work as described here.
- To the extent the law allows, we are not responsible for damage caused because an alert or a reminder did not arrive, or arrived late, because of something outside our control, such as a fault in a network, at a provider or in a phone.
- Nothing in these terms takes away a consumer right that the law gives and that cannot be waived.
12. Changes, and ending the service
- When these terms change, this page and the date at its top are updated. A change for the worse for someone who pays applies only from the first charge more than 30 days after they were told of it, and they can cancel before then at no cost.
- If everything in the paid version opens to every family for free, the charges will stop, and the unused part of the paid month will be refunded.
- If we stop the paid version or the whole service, notice will be given at least 30 days ahead, the charges will stop, and the unused part of a paid month will be refunded.
13. Privacy
- What the payment page keeps, and for how long, is described in the privacy notice on the payment page itself. What the app keeps is described in the privacy policy.
- Paddle receives the email address, the country and the payment details, and handles them under its privacy notice.
14. Law and courts
- Israeli law applies to these terms. This does not take away any consumer right that the law of the country you live in gives and that cannot be waived.
- The purchase itself is also subject to Paddle's Buyer Terms.
- A dispute will be heard by the court that has jurisdiction under the law.
